Legal Framework of Abortion in Zambia

The Act of Parliament that is referred to is the Termination of Pregnancy Act. Termination of
Pregnancy Act Chapter 304 of the Laws of Zambia. The Termination of Pregnancy Act provides that a
registered medical practitioner may terminate a pregnancy where the following conditions are met :
The registered medical practitioner is accompanied by two other registered medical practitioners. All three medical practitioners are of the opinion that the continuance of the pregnancy would involve: –

  • Risk to the life of the pregnant woman; or
  • Risk of injury to the physical or mental health of the pregnant woman; or
  • Risk of injury to the physical or mental health of any existing children of the pregnant woman; or that there is a substantial risk that if the child were born it would suffer from such physical or mental abnormalities as to be seriously handicapped.

The presence of the two other registered medical practitioners is not required where the procedure
is necessary to save the life or to prevent grave permanent injury to the physical or mental health of
the pregnant woman.
The Act further states that a medical practitioner cannot be forced to perform an abortion if that
medical practitioner has a conscientious objection to the abortion, unless the procedure is necessary
to save the life or to prevent grave permanent injury to the physical or mental health of a pregnant
woman. “Conscientious objection” means that a medical practitioner may refuse to conduct an abortion based on reasons of morality or conscience, like it is against their religious beliefs.

PENAL CODE ACT CHAPTER 87 OF THE LAWS OF ZAMBIA

The Penal Code Act creates offenses related to circumstances where a pregnancy is not terminated according to the Termination of Pregnancy Act. It states that: 

  • Any person who aids a woman to terminate a pregnancy by any means is liable to imprisonment for  fourteen years.
  • Every woman who uses any means to terminate her pregnancy, or permits another to terminate her pregnancy is liable to imprisonment for seven years.
  • Any person who supplies to or procures for any person anything knowing that it is intended to be used to terminate a pregnancy is liable to imprisonment for three years.
